Licenses

Amusement Device

In order to operate Amusement Devices, an Amusement Device License must be obtained from the City Clerk's Office. An Amusement Device is defined as any machine or device which is coin operated or otherwise available for hire, which machine or device permits a person or operator to use the device as a game or contest of skill, whether or not registering a score. It shall include, but not be limited to, such devices as electronic or mechanical game machines, shooting gallery type games, pinball machines, skee ball, bowling machines, or any other mechanical or electronic games or operations similar thereto.

Procedure:The application form for an Amusement Device license is available from the City Clerk's Office at City Hall. The application and fee are to be submitted to the City Clerk's Office once a calendar year.

Cereal Malt Beverage License

In order to sell 3.2% cereal malt beverages for consumption on the premises, or to sell any cereal malt beverages at retail only in the original and unopened container and not for consumption on the premises a Cereal Malt Beverage License must be obtained.

Procedure

In order to qualify for a Cereal Malt Beverage License, the applicant must be:

  • Not Less the 21 years of age.
  • A citizen of the United States.
  • A resident in good faith of the state of Kansas for at least one year immediately preceding application and a resident of Sumner County for at least six months prior to filing the application.
  • A person who has not been convicted of a felony or adjudged guilty of any intoxication liquor law of any state.

The application form for a Cereal Malt Beverage License is available from the City Clerk's Office at City Hall. Verification of the above requirements and general information about the applicant and proposed business location are required.

The application and fee must be submitted to the City Clerk's Office 15 days in advance of the City Council Meeting at which the license will be considered. Upon completion of the application form, the Wellington Police Department will run a records check on all applicants. The Wellington Fire Department will inspect the premises to ascertain compliance with the fire codes and/or ordinances of the city. When the application is approved, staff will then place the application on the agenda for the next City Council Meeting for approval. An applicant who does not already hold a cereal malt beverage license in the city will be required to attend the Council Meeting when the application for a new license is considered.

Drinking Establishment Licenses

Any person wanting to open a Liquor Store, Class A, Class B, or Drinking Establishment in the City of Wellington will need to obtain a license.

Procedure

Before you may obtain a license you will need to purchase your state license from the State of Kansas Department of Revenue, Division of Alcoholic Beverage Control. They are located in Topeka and can be reached by phone at 1-877-526-7738. Your state license is then presented to the City Clerk's Office and a copy is made for the city's records. Upon payment of the fee, the City Clerk shall issue a City License. Hours of operation for serving alcoholic liquor are between the hours of 9:00 A.M. to 2:00 A.M. If your business has more than 30% in food sales, you may sell alcoholic liquor on Sundays in addition to your Monday through Saturday sales.

  • Class A Club License - $100.00
  • Drinking Establishment License - $250.00

This license is good for one year from the date it is purchased from the State.

Dog Tag Licenses

Every person owning, keeping or harboring a dog within the city limits shall cause to be registered the name, description of the dog in a record to be kept by the City Clerk for that purpose and shall pay each year to the City Clerk, or to any veterinarian duly authorized by the clerk, before registering such mammalian pet, a fee of

  • $3.00 for each neutered male, or spayed female dog, or
  • $6.00 for each male dog not neutered, or each female dog, not spayed, so registered.

A certificate of a duly licensed veterinarian shall be filed with the city clerk as proof of the fact the male dog has been neutered or the female dog has been spayed.

All dogs shall be registered annually, regardless of age.

The tax herein specified shall be due and payable on January 1st of each year, and if the same is not paid on or before March 1st a penalty of $1.00 shall be charged in addition to the license fee, plus an additional penalty of $.50 per month thereafter, until the license fee is paid. Any person who shall become the keeper or harborer of a dog, at any time after January 1st in any year, shall pay the required license fee within 30 days after the person becomes the keeper or harborer of such dog. Kennel Licenses must be approved by the City of Wellington Engineering Department for zoning.

Fireworks

In order to sell fireworks within the city limits of Wellington, you must first obtain a license from the City Clerk's Office. No person, firm or corporation shall store, sell, possess or discharge fireworks at temporary retail stands or other locations, or deliver within the City of Wellington, Kansas, retail fireworks before 12:00 p.m. the 30th day of June and after 12:00 p.m. on the 5th day of July. Retail sales hours shall be from 10:00 a.m. to 10:00 p.m. on July 1st thru July 4th.

Legal discharge hours shall be from 10:00 a.m. to 11:00 p.m. on July 1st thru July 3rd and 10:00 a.m. to 12:00 o'clock midnight July 4th.

Class C fireworks (common fireworks) are the only fireworks allowed within the city limits of Wellington. Bottle Rockets are strictly prohibited (K.S.A. 31-155).

Procedure

In order to qualify for a Fireworks License the applicant must first:

  • Complete an application.
  • Provide a fee of $500 if the fireworks stand is 1,000 square feet or less; or a fee of $5,000 for a fireworks stand of more than 1,000 square feet.
  • Have written permission from the property owners in order to sell, unless the property is that of the seller.
  • Provide a Bond or Certificate of Insurance in the amount of $500,000.00, with coverage and policy numbers.
  • Provide a Kansas Sales Tax Number.
  • Follow a checklist of guidelines provided by the Wellington Fire Department.

Mobile Home Park License

Any person wishing to operate a mobile home park within the corporate limits of Wellington shall obtain a Mobile Home Park License issued by the City of Wellington. The annual fee for each mobile home park shall be $50 or $5 for each mobile home space, whichever is greater. All licenses shall be good for a calendar year and expire December 31st of that same year. Any license issued prior to July 1st of any year shall pay the annual fee; any license issued after July 1st of any year shall pay one-half of the annual fee, (this only pertains to new parks).

Renewal notices for existing parks will be sent out each November with the fee due and payable on or before December 31st of that year.

Anyone wishing to establish a new mobile home park within the corporate limits of Wellington, or within its 3-mile zoning jurisdiction should contact the Wellington Engineering Department to acquire the appropriate zoning and building code requirements for a new park.

Mobile home parks outside the city limits but within the 3-mile zoning jurisdiction do not require a Mobile Home Park License through the City of Wellington, however, they are subject to zoning regulations.

Occupational License

Any person soliciting within the corporate limits of the city must first obtain an Occupational License from the City Clerk's Office. Soliciting is defined as:

  • Selling or offering for sale, or attempting to take orders for the sale of goods, merchandise, foodstuffs or services of any kind, character or description.

Procedures

The application form for an Occupational License is available from the City Clerk's Office at City Hall. In order to obtain an Occupational License an applicant must provide:

Fees

  • $10 per day, or
  • $250 per year ·

The Standard Traffic Ordinance prohibits soliciting from any motor vehicle within the streets or from the curb.

Pest Control License

In order to do any kind of exterminating of pests, you must first obtain a Pest Control License.

Procedures

Any person holding a currently valid Pest Control Operation's License for the State of Kansas, who shall conduct or pursue the business of a pest control operator, for the fields of operations licensed by the State of Kansas.
